Entered Plea Of No Contest To Felony Murder In The First Degree

Noah J. E. Farr, 32, appeared in the Greenwood County District Court before Judge Mike Ward on Tuesday, May 2, 2023.

Farr, one of five defendants who faced charges in the 2020 burglary which resulted in the death of 78-year-old Danny Shue, appeared in person and through Defense Counsel Brian Duncan for what was originally slated to be a hearing to address a motion for continuance filed by the defense as Jury Trial was slated to begin Monday, May 8, 2023. It was noted as court convened that a plea agreement had been reached in the case.

In the plea offered by the State, for Farr entering a plea of no contest to count one: Felony Murder in the first degree, with the underlying felony of Aggravated Burglary, during the commission of which Shue was killed, remaining counts (Count 2, Aggravated Burglary; Count 3, Theft of Property or Services and Count 4, Conspiracy Theft of Property of Services) would then be dismissed. As part of the agreement, the State would also dismiss Case 2023 CR 27 and elected not to file charges against Farr in regards to investigation of a pending arson case from November 2022.

It was noted during proceedings that an amended complaint was filed in October 2021. The nature of this amendment was explained by Duncan who shared that he believed this was done for the addition of witnesses.

During proceedings, Judge Ward referenced the Kansas Sentencing Guidelines grid sharing that most offenses fall on this, however this does not and is considered off grid.

Farr was later sentenced to life in prison. He will not be eligible to be considered for parole until he has served 25 years towards the sentence.
