Although testimony concluded last Wednesday, Oct. 23, in the civil bench trial of Scott Cheever vs. the State of Kansas, a ruling on the case has not yet been shared.
The 2018 civil case began after Cheever, who was convicted of murdering Greenwood County Sheriff Matt Samuels on Jan. 19, 2006, filed a 601507 motion claiming his legal counsel had been ineffective in regards to aspects of his trial and proceedings. This filing came after Cheever had exhausted all appeal efforts.
Testimony continued last Tuesday and Wednesday pertaining to expert Dr. Robert Smith not being called to testify; as well as voir dire errors (note: voir dire is the process of selecting impartial jurors).
The six-day trial recessed Wednesday, Oct. 23 and noted they would reconvene after the transcripts of the trial had been completed.
When the court reconvenes in this case, it is believed that both Cheever’s attorneys and the state will present closing arguments. The judge will then begin judicial deliberation by the judge, which may take weeks or even months.
